These Terms of Service ("Terms") are an agreement between you and College Monte Carlo ("College Monte Carlo," "we," "us," or "our") governing your use of our websites at collegemontecarlo.com and app.collegemontecarlo.com and the tools we provide (the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. What the Service is
College Monte Carlo is an educational planning and estimation tool. It uses public data (such as Common Data Set statistics) and an agent-based Monte Carlo simulation to model possible college-admissions and cost outcomes. The Service provides estimates and information to help you plan. It is not professional, legal, financial, or admissions advice, and it is not a substitute for your own research or for guidance from a qualified counselor.
2. No guarantee of outcomes
Admissions and financial-aid outcomes depend on many factors outside any model. Our simulation produces probabilities and ranges, not predictions of what will actually happen to you. We do not guarantee admission to, rejection from, or any particular cost at any school.
You are responsible for your own application decisions. Always verify deadlines, requirements, costs, and other facts directly with each college.
3. Eligibility and accounts
You may use the Service if you can form a binding agreement with us, or if you are a minor using it with the involvement of a parent or guardian. You agree to provide accurate information, to keep your account secure, and to be responsible for activity under your account. We sign you in by emailed link or by Google; you are responsible for maintaining access to the email you use.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- copy, scrape, harvest, or bulk-extract data from the Service except as expressly permitted;
- reverse engineer, decompile, or attempt to derive source code, except where that restriction is prohibited by law;
- interfere with, overload, or disrupt the Service or its infrastructure;
- attempt to access accounts or data that are not yours; or
- resell or commercially exploit the Service or its outputs without our permission.
5. Your content
You keep ownership of the information you enter (your "Inputs"). You grant us a limited license to store, process, and display your Inputs solely to operate and improve the Service for you, as described in our Privacy Policy. You are responsible for your Inputs and for having the right to provide them.
6. Our content
The Service — including the simulation, software, text, design, and original data compilations — is owned by College Monte Carlo and protected by intellectual-property laws. Underlying public data (such as Common Data Set figures) belongs to its respective sources. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own college planning. All rights not expressly granted are reserved.
7. Payments
The full product may be offered as a paid feature. If you purchase, the price and any terms will be shown at the time of purchase, and payment will be handled by our payment processor (Stripe). Unless required by law or stated otherwise at purchase, fees are non-refundable. We may change prices prospectively.
8. Third-party services and links
The Service relies on third-party providers (such as Cloudflare, Google, Resend, Stripe, and Plausible) and may link to third-party sites. We are not responsible for third-party services or content, and your use of them is governed by their own terms.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that estimates or data will be accurate or complete.
10. Limitation of liability
To the fullest extent permitted by law, College Monte Carlo and its founders will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, opportunities, or admissions or financial outcomes, arising from your use of the Service. To the extent we are found liable, our total liability will not exceed the greater of the amount you paid us in the twelve months before the claim or US $50.
11. Indemnification
You agree to indemnify and hold harmless College Monte Carlo and its founders from claims arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Sections that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will survive.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Significant changes take effect when posted; your continued use after changes means you accept them.
14. Governing law
These Terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Florida, unless applicable law requires otherwise.
